Political asylum in Germany
Asylberechtigung is granted to people persecuted on grounds of race, nationality, political opinion, religion or membership of a social group. It is a constitutional right of Germany to recognise political refugees. Holders of Asylberechtigung have unrestricted access to the labour market and a privileged route to family reunification. Protection is not granted where exclusion grounds apply: war crimes, serious crimes, a threat to security. The state provides accommodation support and social services while the application is being examined.

Arrival from a safe state (the EU, Norway, Switzerland)
The procedure follows the Dublin Regulation; the application is examined by another country
A history of war crimes or crimes against humanity
Criminal proceedings; asylum is excluded
A conviction for a serious crime carrying three years or more
Protection is refused; subsidiary protection may be considered instead
Poverty, unemployment, civil war or natural disasters as the only grounds
Social assistance under national policy or asylum in other countries

The residence permit (Aufenthaltserlaubnis) granted on the basis of Asylberechtigung is valid and can be renewed each time for a set period, provided the grounds for protection remain. After five years of residence the holder may apply for a Niederlassungserlaubnis (permanent settlement permit); with German at C1 and secured means of subsistence this period is reduced to three years.
