Official terms
Financial requirement
Filing Form I-589 costs $100 (a fee introduced by H.R. 1 for applications from 22 July 2025, with no waiver). If the application is undecided for more than a year, an Annual Asylum Fee of $102 per calendar year is charged. Employment authorisation under category (c)(8) costs $560 on first filing and $275 on renewal. The family reunification petition (I-730) is filed free of charge
Timelines and rights
Review time
- Affirmative asylum — Form I-589 goes directly to USCIS, an asylum officer holds an interview and decides
- Defensive asylum — heard by an EOIR immigration judge where the person is already in removal proceedings
- The application must be filed within one year of the last entry, except in cases of proven changed or extraordinary circumstances
Right to work
If the application is undecided for more than 180 days, an employment authorisation document can be obtained (Form I-765 under category (c)(8), which can be filed 150 days after the asylum application). Once asylum is granted, the holder automatically has the right to work without a separate permit
Residence conditions
To apply, the person must be physically present in the USA, regardless of how or whether they entered lawfully. To move to permanent resident status, at least 1 year of continuous physical presence in the USA after the grant of asylum is required

What comes next: permanent residence and citizenship
Route to permanent residence
After 1 year of physical presence in the USA following the grant of asylum, the holder may file Form I-485 for a green card. The date permanent resident status is granted is backdated by 1 year from the date the I-485 is approved
Route to citizenship
Naturalisation comes after 5 years of continuous residence as a permanent resident. Since the green card date is backdated by 1 year, the citizenship application can in practice be filed about 4 years after the I-485 is approved
