Protection of employment rights in the UAE
An audit and protection of employment relations in the UAE on the employer's side: contracts, internal policies, personal data and lower risk when hiring and dismissing. The work is done for the company, not for the employee.
How to protect an employee's rights in the UAE
An employee in the UAE is protected by law more strongly than people assume, but the protection does not operate by itself. A dispute is first heard by the labour ministry, and only if no agreement is reached does the case go to court.
The employee's weak spot is deadlines and evidence. You have to come forward quickly and support the claims with documents: the contract, payslips, correspondence about tasks and about the dismissal.
The two legal systems of the UAE: why this decides the outcome of a dispute
Two incompatible legal systems operate in the UAE at the same time. The main territory runs on civil law set out in codes, proceedings are held in Arabic, and the emirate's courts decide.

Inside the financial centres — DIFC in Dubai and ADGM in Abu Dhabi — common law of the English type applies, with their own courts and their own procedure. Proceedings there are conducted in English.
The practical conclusion: jurisdiction is determined by what the contract says and where the parties are registered, not by where you live. A jurisdiction clause signed without reading sets the language of the proceedings, the cost of representation and the rules the case will be judged by.
Only a lawyer admitted to practise in the DIFC itself may represent a party before the DIFC courts. Admission to the emirate's courts does not apply there, and vice versa.
What employees come with
- Unlawful dismissal
- Unpaid salary and the final settlement on dismissal
- Refusal to pay compensation for unused leave
- Contract terms that worsen the employee's position
- The employer withholding documents
An employee visa is tied to the employer: on dismissal the status changes, and the time allowed to move on or to leave is limited. That is factored into the strategy for the dispute.
