Guest self-employment in Hungary

A residence permit for third-country nationals carrying on independent business activity or holding management positions in Hungarian companies. It requires proof of the registration of the activity, financial standing, accommodation and health insurance. It is issued for a limited period with the possibility of renewal, while actual employment requires an additional permit.

Ways of filing the application

The application may be filed either from abroad at a consulate, or in Hungary through the Enter Hungary system if the conditions are met.

From abroad

  • Nationals living in a foreign country
  • Filing at the Hungarian consulate in the country of citizenship or residence
  • A valid passport is required, valid for at least 3 months

From within Hungary

  • Nationals present in Hungary under the visa regime

Documents to gather

The full set of documents must prove the purpose of the stay, financial standing, accommodation and insurance.

  • Valid passport (valid for at least 3 months)
  • One colour photograph (size as required)
  • Registration number as a sole trader (for sole traders)
  • A detailed description (in Hungarian or English) of the business activity you plan to carry on
  • Service agreements, client contracts or documents proving the business activity
  • Bank account statement, proof of a deposit or of a securities portfolio as evidence of financial standing
  • Tax certificate or a document on earning capacity (if available)
  • Tenancy agreement, title deed to the accommodation or the owner's written consent to your living there
  • Proof of health insurance (a social or private insurance policy) or a certificate of the ability to pay for medical services

How the process runs

The process involves preparing the documents, filing the application and registering regularly throughout the validity of the permit.

    Preparing the document pack

    Collect all the necessary documents: passport, proof of registration as a sole trader, description of the activity, contracts, account statements, documents on accommodation and health insurance.

    Filing the application

    File the documents either at a Hungarian consulate (if you are abroad) or through Enter Hungary or in person at a regional OIF office (if you are in Hungary). When filed abroad, the examination is carried out by the consulate; when filed in Hungary, by the OIF.

    Examination of the application

    The state authority (the consulate or the OIF) checks the documents and takes a decision within 21 days from the moment the application is complete.

    Receiving the permit

    After a positive decision the permit is issued and takes effect. The permit is valid for a maximum of 1 year from issue. The authorities must be notified of your actual arrival within 3 months.

    Regular registration

    While the permit is valid you must report to the immigration authorities regularly. This can be done through Enter Hungary, through the e-papír service or in person at a regional office. Contact your local OIF office to confirm the schedule of appearances.

    If you plan to stay in Hungary, file the renewal application 30-90 days before the current permit expires. Renewal is possible for a maximum of 2 further years, but the total period must not exceed 3 years from the date the permit was first obtained.

Family members may obtain a residence permit on the basis of family ties, but time limits apply.

Spouse, children, parents
Family members may apply for a residence permit on the basis of family reunification, but not during the first year of your permit. Exception: children born in Hungary may be registered. Each family member must file a separate application and meet the family reunification requirements.

The permit may be renewed once for a maximum of 2 additional years, provided the total period does not exceed 3 years from the first issue. Renewal requires an application 30-90 days before the current permit expires. The conditions for renewal are: a valid permit at the time of filing, a stay in Hungary of at least 90 days within each 180-day period, and compliance with the requirements for regular registration and reporting through Enter Hungary or at the immigration authority. On renewal, proof of financial standing, accommodation and insurance is required again.

What legal basis is needed to register as self-employed in Hungary?
You must register your sole-trader business activity with the Hungarian authorities (usually the local tax office or the sole-trader registration authority). To apply for the permit you need the registration number or a copy of the registration certificate.
May I take up employment while holding a guest self-employment permit?
The permit gives the right only to independent activity and management positions. If you plan to work as an ordinary employee of a company, you will need a separate work permit or the Magyar Kártya (Hungarian Card). Employment without the appropriate permit is prohibited.
What sums are needed to prove financial standing?

May my family obtain a residence permit with me as soon as I arrive?
No. Family members cannot obtain a residence permit on the basis of family reunification during the first year of your permit. Once the year has passed you may apply for their permits separately. The exception is children born in Hungary during your stay, who may be registered.
What is the maximum period I may stay in Hungary on this permit?
The first permit is issued for a maximum of 1 year. It may be renewed once for a maximum of 2 years, but the total period must not exceed 3 years from the first issue of the permit. After 3 years you will need another status or permit to continue living in Hungary.
