UAE staff visas 2026: quotas and establishment card

You cannot hire in the UAE without an establishment card, a MoHRE file and a free visa quota. The order of steps, timelines and permits from AED 250.

A company in the UAE cannot hire its first person until it is registered with two separate authorities and has checked its free quota. The order is not obvious: the establishment card, the employer file and the quota are arranged separately, and each one is tied to a valid trade licence.

Here is what to prepare before the vacancy, how the quota is counted, what a work permit costs and what makes a company lose the right to hire.

Three documents you cannot hire in the UAE without

Each takes from a week to a month, and all three hang on the licence. Let the licence lapse and the employer file stops working, so employee visas cannot be renewed. Let the establishment card expire and the company's visa work halts: no new visas, no renewals of existing ones.

The card is needed even by a one-person company. If the owner is arranging a residence visa for themselves, registration with immigration is mandatory — an establishment card in the UAE takes 7 to 30 days.

The employer file is needed earlier than you think

Registration with MoHRE gives the company an electronic employer file. All personnel work runs through it: contracts, changes of terms, terminations and labour disputes.

You need the file before hiring your first person, including the case where the owner puts themselves on the payroll. Without it a work permit will not be issued.

The paperwork and timelines differ between free zones and the mainland. MoHRE registration is usually arranged right after the licence, so the first hire is not delayed.

How a company's visa quota is calculated

The quota is the number of residence visas a company may issue. Its size depends on three things: the licence type, the floor area of the leased premises and the activity. Each free zone has its own calculation rules.

Three points people learn too late:

  • the owner's own visa uses up a slot exactly like an employee's;
  • a slot frees up only when a departing employee's visa is cancelled, not on their last working day;
  • a virtual address caps the quota harder than leased premises, because floor area feeds the calculation.

A concrete example from the Ajman free zone: a Flexidesk workspace allows up to four visas, and from the fifth the zone requires an office on its territory — the size of that office makes no difference.

When no slots are left, the quota is raised in one of three ways: changing the licence package, leasing larger premises or filing a justification based on the hiring plan. That takes time, so visa quotas in the UAE are checked before the vacancy goes out, not after the offer is made.

Work permits in the UAE: 13 types and a price from AED 250

Under article 6 of Federal Decree-Law 33 of 2021 it is illegal to work in the UAE without a MoHRE permit, and equally illegal for an employer to hire without one. The ministry issues 13 types of permit in total.

Issuing or renewing costs between AED 250 and AED 3,450. The spread comes from the company's category: A, B or C. The category reflects how the company complies with labour law, ministerial decisions and the WPS wage system. Offenders sit in category C and pay the most for every permit.

What stops a permit being issued

The conditions are simple: the worker is at least 18, the occupation matches the company's activity, the licence is valid and free of violations, and the application is filed by someone authorised to represent the company.

The ministry may refuse to issue or renew, and may cancel permits already granted, if the company submits incorrect documents, turns out to be fictitious or does not carry on its registered activity, or if it fails to comply with the WPS wage system.

A separate mechanism is the administrative suspension of a company's file under ministerial resolution 543 of 2022. No new permits go to a company that breaches the rules on fees and fines, fails to provide compliant labour accommodation, faces human trafficking allegations or abuses its access to ministry systems.

How long hiring an employee takes in the Emirates

The procedures have been pulled into a single Work Bundle platform. According to the government portal it merged five systems into one: 5 steps instead of 15, 5 documents instead of 16, 2 in-person visits instead of 7, and the processing time cut from 30 working days to 5.

In-person visits remain where a person genuinely has to appear: the medical test and biometrics for the Emirates ID. That is why a candidate who already holds a residence visa starts work noticeably sooner than someone arriving from abroad.

The full route for someone coming from abroad looks like this:

  3. 3an entry visa is issued for the candidate;

Where a company should start

Assemble the chain in advance: licence, establishment card, employer file, a quota calculated against a year's hiring plan — and only then the vacancy. That order saves weeks, because every next step rests on the previous one.

If the company is already running, start by checking the dates: is the establishment card still valid, does the licence expire in the coming months, and how many slots are left in the quota.

Common questions

Is an establishment card needed if there will be no employees?
Yes, if the company issues even one residence visa, including the owner's own. The card links the company to the immigration system, and without it no visa is granted. An expired card also blocks the renewal of visas already in force.
Does a slot free up in the quota when an employee leaves?
Only once their residence visa has been cancelled. While the visa is valid the slot stays occupied, even if the person no longer works at the company. That is why cancellation is filed straight away rather than left until the next hire.
Can you hire a candidate who holds another employer's visa?
Yes, in two ways. Either the candidate cancels the previous visa and moves to you entirely, for which there is a dedicated permit type covering transfers between companies; or they keep the existing visa and take out a part-time work permit with you.
How much does a work permit cost in the UAE?
