Seasonal work permit in Montenegro
The permit combines the right to live in Montenegro with the right to work for a local employer in a seasonal position — in tourism, agriculture, construction and other sectors with peak workloads. The application is filed in person at a Ministry of the Interior office inside the country: the law provides for filing through a consulate, but the authority has never put it into operation. The permit is tied to the employer and the vacancy from the job offer, and the term is limited in advance.
Who files the application — the worker or the employer
The law allows the application to be filed in two ways: the foreign national does it themselves or, by way of exception, the employer does it for them.
The foreign worker files in person
- You hold a written offer from a Montenegrin employer for a specific seasonal position
- You come to Montenegro in person and file the application at the Ministry of the Interior branch for the place where you intend to stay
- At filing a photograph, the fingerprints of two fingers and an electronic signature are taken — you also collect the finished permit in person
The employer files instead of the worker (a statutory exception, rarely used)
- The employer is registered and genuinely carries on economic activity in the place where the worker is to stay
- The employer files the application at the Ministry of the Interior branch without waiting for the worker to arrive
- Once the permit is issued, the employer must conclude an employment contract and register the worker for compulsory social insurance
When the programme is not a fit
You are looking for permanent work with one employer for the whole year rather than only for a season
The residence and work permit through employment (not seasonal) — issued for a term of up to a year and renewable for a maximum of two years
Your future employer has already been penalised several times for the illegal employment of foreign nationals, is in bankruptcy proceedings, does not carry on economic activity or has tax arrears
By law the Ministry will not issue a permit in that case — a different employer is needed, or these grounds for refusal have to be removed
You are counting on filing the application through the Montenegrin consulate at home and not travelling to the country in person
In practice this option does not work — the Ministry itself acknowledges that it has not built the technical basis for it and proposes deferring it until Montenegro joins the EU; the application has to be filed in person at a Ministry branch inside Montenegro

Documents to gather
The law requires the same evidence both for ordinary filing inside Montenegro and for the filing through a consulate provided for on paper.
- A written offer from a Montenegrin employer of work in a specific seasonal position
- Confirmation of the level of education and professional qualifications
- A medical certificate of fitness for the work
- A valid passport (or a foreign identity document) valid for at least three months longer than the stay requested
- Proof of sufficient means of subsistence
- Confirmation of secured accommodation in Montenegro
- A health insurance policy
- A criminal record certificate — both in Montenegro and in the country of origin — with no sentence of imprisonment of more than six months
- The employer's registration documents confirming that it genuinely carries on economic activity

Filing the application with the Ministry of the Interior
The foreign national files the application for residence and work under seasonal employment in person at the Ministry of the Interior branch for the place where they intend to stay (or the employer does so for the place of its activity). At filing a photograph, the fingerprints of two fingers and an electronic signature are taken, and the job offer, confirmation of education and qualifications, the medical certificate and the other documents are attached together with the receipts for the fees.

Checking for threats to national security
Before deciding on the application, the Ministry of the Interior obtains a preliminary opinion from the National Security Agency and the police that there are no obstacles on the applicant's part. If no reply arrives within the prescribed period, the authority treats it as meaning that there are no obstacles to issuing the permit.

Decision on the application
15 daysThe Ministry of the Interior decides on the application within 15 days of the date of filing. A refusal is issued as a formal decision, which may be appealed to the second instance of the same ministry within 8 days of receipt.

Receiving the permit
When the application is accepted, the Ministry of the Interior issues a certificate stating the deadline by which the finished permit must be collected. From the moment of receipt the foreign national has both the right to be in Montenegro and the right to work for the named employer in the seasonal position.

The employer concludes the employment contract
8 daysWithin 8 days of the permit being issued the employer must sign an employment contract with the worker and register them for compulsory social insurance under employment law.
Trips, renewal and the grace period
Permanent residence is applied for after 5 years of continuous temporary residence. A seasonal permit is valid for up to 6 months within a year and, by way of exception, is extended by a further 2 months — up to 8 months in a year.
The permit is issued for a term of up to six months within a calendar year. If the seasonal work objectively requires more time, the Ministry of the Interior may extend it by a further two months — with the same employer or another one — but the total period of stay and work on this ground still cannot exceed eight months in a year. A separate administrative fee of 30 euros is paid for the extension.
